The grounds for divorce are the legal basis for dissolving the marriage. In Pennsylvania & New Jersey, either a period of one year (if separated after December 2016) or a period of two years of separation (if the separation was before December 2016) without reconciliation will establish grounds for divorce. In addition, Pennsylvania & New Jersey allows the establishment of grounds for divorce by mutual written consent 90 days after the divorce is served. Pennsylvania & New Jersey also allows for divorce under certain fault grounds, including desertion, adultery, cruel treatment, imprisonment and insanity. You will not be divorced, however, until you have grounds and an agreement or hearing on how to divide debts and alimony.
